JOB DESCRIPTION/DUTIES: The Senior FOIA and Privacy Act Analyst will provide specialized Freedom of Information Act (FOIA) and Privacy Act (PA) support to the National Institutes of Health (NIH). The position independently manages complex information requests from intake through final disposition; reviews, analyzes, and redacts responsive records; conducts legal and policy research; drafts correspondence, memoranda, and final response letters; supports administrative appeals and litigation-related coordination; and maintains complete, accurate, and timely case records. The Analyst will apply federal disclosure laws, HHS regulations, NIH policy, and relevant court decisions to protect sensitive information while promoting lawful and transparent access to agency records. FOIA and Privacy Act Case Processing
Independently process FOIA and Privacy Act requests from receipt through closure, including intake review, scoping, tasking, record collection, document review, correspondence, memoranda, redaction, release, and case-file documentation.
Research, analyze, and evaluate responsive records and supporting data to determine releasability and prepare accurate, timely information-request responses.
Draft final response letters for full releases, no-record responses, routine partial releases, fee matters, referrals, consultations, and other case dispositions.
Review documents and proposed responses for accuracy, consistency, completeness, and compliance with the FOIA, Privacy Act, HHS FOIA regulations, NIH policy, and applicable procedures.
Refer or coordinate requests with the appropriate office, NIH Institute or Center, HHS component, or other federal agency when responsive records or subject-matter responsibility reside elsewhere.
Assist requesters in reasonably describing records, clarifying scope, narrowing requests, and identifying practical approaches that satisfy information needs while supporting efficient processing.
Legal, Regulatory and Policy Research & Analysis
Conduct research on federal disclosure laws, regulations, policies, guidance, and precedents to determine whether requested information may be released and document the results of the analysis.
Analyze FOIA exemptions, Privacy Act restrictions, confidentiality protections, and relevant case law involving personal privacy, proprietary commercial or financial information, ongoing investigations, and predecisional or deliberative material.
Draft legal and policy memoranda presenting facts, applicable authorities, analysis, conclusions, and recommended release determinations.
Analyze new or revised laws, regulations, court decisions, policies, and procedures and provide written assessments of their effect on existing NIH FOIA/PA practices.
Identify policy, process, or documentation gaps and recommend practical updates that improve compliance, consistency, timeliness, and defensibility.
Administrative Appeals, Sensitive Matters & Litigation Support
Review administrative appeals concerning the non-release of information, partial denials, adequacy of searches, procedural determinations, or fees assessed under the FOIA.
Evaluate appeal records in light of applicable statutes, regulations, case law, agency policy, and any additional justification submitted by the requester.
Participate in meetings and discussions with attorneys concerning agency responses to FOIA or Privacy Act litigation and prepare supporting analyses, chronologies, case documentation, or correspondence as requested.
Coordinate with requesters, records custodians, program officials, attorneys, congressional staff, and NIH intramural or extramural personnel to resolve sensitive or contested disclosure issues.
Negotiate informal agreements and support formal agreements to resolve conflicts between requesters and providers of information, including scope, timing, format, search parameters, and staged productions.
Case Management, Communications & Reporting
Use automated FOIA or case-tracking systems to record, monitor, and update requests, consultations, referrals, appeals, correspondence, deadlines, processing milestones, and final dispositions.
Maintain complete and well-organized electronic case files containing requests, tasking records, search documentation, responsive records, review notes, consultations, correspondence, determinations, and closure materials.
Extract and reconcile information from case-management systems, correspondence, and other sources to prepare status reports, workload summaries, and management information.
Draft and submit a weekly progress report to the Branch Chief describing the status of assigned FOIA/PA cases, completed actions, upcoming deadlines, risks, and other activities.
Communicate professionally with consumers, members of the public, special-interest groups, attorneys, congressional staff, agency leadership, and internal program personnel on behalf of NIH.
EDUCATION/EXPERIENCE/EXPERTISE REQUIREMENT:
Master's degree in law, public administration, political science, information management, records management, criminal justice, communications, or a closely related field.
Expert knowledge of the Freedom of Information Act, Privacy Act of 1974, HHS FOIA regulations, federal disclosure policy, and relevant judicial and administrative precedents.
Experience coordinating complex requests with program offices, records custodians, agency counsel, senior leadership, requesters, and other federal organizations.
Experience using automated FOIA, records, document-review, or case-management systems to track actions, deadlines, correspondence, and dispositions.
Advanced research, legal analysis, critical thinking, writing, editing, negotiation, and oral communication skills.
Ability to independently manage a high-volume caseload, prioritize competing deadlines, exercise sound judgment, safeguard sensitive information, and produce accurate work with limited supervision.
Demonstrated proficiency with Microsoft Office Suite, including Word, Excel, Outlook, Teams, and SharePoint, and with Adobe Acrobat or comparable electronic redaction tools.
PREFERRED EDUCATION/EXPERIENCE/EXPERTISE:
Certified Information Privacy Professional/Government (CIPP/G), Certified FOIA Professional, or other relevant legal, privacy, records, or information-governance credential.
Experience supporting NIH, HHS, or another federal health, scientific, or research organization.
Experience handling administrative appeals, litigation holds, litigation support, congressional or media-interest requests, and matters involving confidential commercial information or sensitive research records.
Knowledge of federal records management, e-discovery, document preservation, and Section 508 requirements as they relate to information release.
Experience developing FOIA/PA standard operating procedures, templates, quality-control checklists, workload metrics, dashboards, or process-improvement recommendations.
Experience communicating with attorneys, congressional offices, regulated entities, researchers, grantees, members of the public, and special-interest organizations.
